Department of Revenue
FONCE Form Update
On June 13 the Department of Revenue mailed a request for information letter and Disclosure of Activity form
to all family-owned noncorporate entities (“FONCE”) currently
registered as exempt for franchise and excise tax purposes. The letter
asked the FONCE to complete the disclosure of activity form and
return it to the Department by July 18 or risk revocation of the FONCE’s exempt status.
If your client is not a FONCE but
receives a Disclosure of Activity form, he or she should
fill in the name,
address and FEIN information at the top of the form and then indicate
on the top of the form that this entity is exempt under a different
code section. The applicable code section or type of exemption as
reported to Tennessee on the Application of Exemption should be noted
on the form in the upper right hand corner. The form should still be
signed, dated and returned by July 18.
For more information, including a link
to the Disclosure of Activity form, please see
http://www.tscpa.com/hotwire/FONCE061208.html.
